1. CONTRACT OF SALE & CATALOG FLUIDITY 1.1 The Transaction: By placing an order, you enter a bipartite contract with either the third-party Seller or Nijikart (for exclusive lines). 1.2 Catalog Fluidity & Availability: Our product catalog is dynamic. We utilize a global manufacturing network where stock levels fluctuate in real-time. Nijikart reserves the right to cancel or pause any order, even after payment, if a manufacturing partner reports a stockout, equipment failure, or regional disruption. 1.3 Automated Processing: Production typically begins within minutes of the Buyer submitting and approving their personalization data via our customization portal, not immediately upon initial payment. Once an order enters "In Production," it is irrevocable except under Section 1.4. 1.4 The "Store Credit" Resolution: If Nijikart cancels an order due to catalog fluidity or manufacturing unavailability (as per 1.2), the Buyer will be issued a full refund in the form of Nijikart Store Credit. This credit is valid for 1 year and can be used across any product on the platform.
2. PERSONALIZATION & GENERATIVE ACCURACY 2.1 Data Responsibility: You are the final editor. Nijikart programmatically composites exactly what you provide in the customization portal. 2.2 Aesthetic Variance: Minor variations in color, AI Face-Swap blending, and "generative artifacts" are inherent to MeCommerce and are not considered manufacturing defects.
3. REFUND & CANCELLATION (THE "CUSTOM GOODS" RULE) 3.1 Pre-Personalization Cancellations: Buyers may cancel an order strictly after the initial purchase but before the submission of personalization data. Any cancellation executed during this window will be refunded exclusively as Nijikart Store Credit. Cash refunds to the original payment method are not permitted. 3.2 Unsubmitted Personalization (Abandoned Orders): If a Buyer completes checkout but fails to submit the required personalization data within 30 calendar days of the original purchase, the order will automatically expire. To protect supply chain allocation, the original purchase amount will be converted entirely into Nijikart Store Credit, valid for 1 year. 3.3 Final Sale: Because items are 1-of-1 creations, once personalization data is submitted and the order enters production, we do not offer refunds or cancellations for "Buyer’s Remorse." 3.4 The "Oops!" Exclusion: We do not offer refunds for buyer-side errors (typos, wrong photo, etc.) realized after submission unless Premium Protection was purchased at checkout. 3.5 Manufacturing Defects: Replacements are provided for verified physical defects (e.g., broken items) reported within 48 hours. No cash refunds are issued for personalized items; only replacements or store credit at Nijikart's sole discretion.
4. PREMIUM PROTECTION (REMAKE SERVICE) 4.1 Remake Credit: This is a one-time service credit designed to cover buyer-side errors (e.g., typos, incorrect photo uploads). 4.2 Dynamic Pricing: The cost to add Premium Protection is highly subsidized on the interface during the initial purchase and is dynamically calculated based on the specific item. 4.3 Subsidized Processing: If Premium Protection was purchased, one remake of the original item is permitted at a fixed, subsidized base fee. 4.4 Variable Shipping for Remakes: The buyer is responsible for the shipping costs associated with the remake. Please note that this shipping fee is calculated dynamically at the time the claim is filed and may differ from the shipping fees paid on the original order. 4.5 Expiration: Claims for a subsidized remake must be filed within 30 days of the original order's delivery date.
5. GLOBAL SHIPPING & VUCA DISRUPTIONS 5.1 Estimates Only: Delivery dates are projections. Nijikart is not liable for delays caused by external factors (e.g., weather, war, port strikes, or customs backlogs). 5.2 Unclaimed Packages: If a package is undeliverable due to buyer error (wrong address/unclaimed), we will attempt one re-delivery at the buyer's cost. No refunds are issued for abandoned custom goods. 5.3 International Duties: The Buyer is the "Importer of Record" and is responsible for all local taxes and customs duties.
6. REPLACEMENT & DISPUTE PROTOCOL 6.1 Verification: Claims require photographic/video evidence via our Support Portal within 48 hours. 6.2 The "Store Credit" Default: In cases where a replacement is impossible due to the reasons in Section 1.2, Nijikart’s maximum liability is limited to the issuance of Store Credit equal to the transaction value.
