Terms and Conditions of NIJITEK PRIVATE LIMITED (Nijikart.com)

INTRODUCTION

Welcome to Nijikart, a hyper-personalized platform for creating children’s books and related products, owned and operated by NijiTek Private Limited (“We”, “Us”, “Our”).

These Terms and Conditions govern the use of our website www.nijikart.com (the “Site”) and the purchase of the products available on the Site (the “Products”). By accessing the Site and/or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our Site.

We may modify these Terms and Conditions from time to time. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

1. DEFINITIONS

• Buyer: The person named on the Order.
• Contract: The Order and Order Confirmation.
• Faulty: Containing a fault or defect; imperfect or defective.
• Order: Your order for a Product from the Site.
• Price: The price, postage and packing costs, and applicable taxes in force at the time of the Order, subject to any promotional offers or discounts.
• Terms and Conditions: The standard terms and conditions set out in this document.
• Site Content: All content, materials, text, images, graphics, logos, and code found on the Site.

2. ACCESSING AND USING THE SITE

You agree to:

• Use the Site only for lawful purposes and in accordance with applicable laws.
• Not misuse or interfere with the security or proper functioning of the Site.
• Comply with any reasonable instructions we provide regarding your use of the Site.

We may review orders for compliance with our guidelines and may refuse to process orders that breach these Terms or our content standards.

3. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the Site and Site Content are owned by NijiTek Private Limited or our licensors.

• Site Content is for personal, non-commercial use only.
• You may not copy, modify, distribute, publish, or create derivative works from any Site Content without prior written consent.

4. ORDERS AND SPECIFICATIONS

• Orders must be placed via the order process outlined on the Site.
• All Products are subject to availability and our acceptance of your Order.
• We reserve the right to reject any Order for any reason before acceptance.
• Acceptance occurs when we send you an Order Confirmation.

It is your responsibility to check the Order Confirmation and notify us promptly of any errors. Any delivery dates given are estimates only.

5. PRICING & PAYMENT

• Prices may change at any time before your Order is accepted.
• We take payment at the time you place your Order through secure third-party payment providers.
• For orders delivered within India, prices include GST and other applicable taxes.
• International orders may be subject to customs duties, import taxes, or fees, which must be paid by the Buyer.

You confirm that all payment details provided are accurate, and that you are authorized to use the payment method.

6. DELIVERY AND ACCEPTANCE

• Products will be delivered to the address specified in your Order.
• We may deliver your Order in instalments.
• Delivery dates are estimates; we are not liable for delays beyond our control.
• Inspect Products upon delivery and report damages immediately.

If delivery is refused, or cannot be completed due to incorrect address details, you may be charged return and re-delivery fees.

7. RISK AND OWNERSHIP

• Risk of loss or damage passes to you upon delivery.
• Ownership remains with us until full payment is received.

8. RETURNS, REFUNDS, AND CANCELLATION RIGHTS

You may cancel an Order only if:
a) We fail to deliver within 40 days of your Order; or
b) The Product is Faulty, and you notify us within 14 days of receipt.

Personalized products cannot be canceled once production has started, except in cases of Faulty goods. Returns must be sent in original packaging.

9. SITE CONTENT AND RELIANCE ON INFORMATION

We make reasonable efforts to ensure Site Content is accurate, but we do not guarantee it will be error-free, complete, or up-to-date. Site Content may change without notice.

10. DISCLAIMERS

The Site and Products are provided “as is” without warranties of any kind, except as expressly stated.
We do not warrant that:

• The Site will be uninterrupted or error-free.
• Defects will be corrected.
• The Site is free from viruses or harmful components.

11. LIMITATION OF LIABILITY

Our liability to you is limited to the Price paid for the Product.
We are not liable for:

We may suspend or terminate your access to the Site at any time, with or without notice, if you breach these Terms.

15. GOVERNING LAW

These Terms are governed by the laws of the Republic of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
