UGC Terms and Conditions

Nijikart – User Generated Content (UGC) Terms & Conditions

Effective Date: 01 January 2022

By sharing content with NijiTek Private Limited (trading as Nijikart), including by:

  • Tagging us in posts on social media,

  • Using our branded hashtags (such as #Nijikart or campaign-specific hashtags),

  • Sending us images, videos, or reviews directly,

  • Participating in contests, campaigns, or promotions where content is submitted,

you grant Nijikart permission to use your User Generated Content (“UGC”) as described in these Terms and our Privacy Policy.

1. Grant of Rights

By submitting, tagging, or otherwise making your UGC available to us, you grant NijiTek Private Limited a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive license to use your UGC in any form or media, including but not limited to:

  • Our websites and online stores

  • Social media channels

  • Email newsletters

  • Digital and print advertising

  • Packaging, product listings, and promotional materials

This includes the rights to:

  • Use, reproduce, adapt, edit, display, and distribute your UGC

  • Create derivative works or combine it with other content

  • Use your name, username, likeness, voice, and location (if provided) in connection with the UGC

2. Your Warranties & Representations

By sharing content with us, you confirm that:

  1. You are at least 18 years old (or have the consent of a parent/guardian if under 18).

  2. You own all rights to your UGC or have permission from all necessary rights holders.

  3. Our use of your UGC will not infringe copyright, trademark, privacy, publicity, or other rights of any third party.

  4. Your UGC does not contain anything defamatory, obscene, unlawful, hateful, discriminatory, or inappropriate.

  5. Your UGC is free from viruses, malicious code, or harmful links.

3. Our Rights & Discretion

  • We are under no obligation to use your UGC.

  • We may remove your UGC from our channels at any time for any reason.

  • Selection of UGC for use is entirely at our discretion.

4. Release & Limitation of Liability

By submitting UGC, you release and discharge NijiTek Private Limited and its representatives from any claims or liabilities related to the use of your UGC, including any adaptations or edits made.

5. Reporting Concerns

If you believe any UGC we are using is inappropriate or infringes on legal rights (such as copyright or trademark), please contact us at:

6. Governing Law

These Terms are governed by the laws of the Republic of India, and any disputes will be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
