1. DATA COLLECTION & CLASSIFICATION

1.1 Identity Data: We collect your name, email, shipping address, and contact number. This is necessary for the performance of the contract (Order Fulfillment).

1.2 Personalization Assets: We collect photos, text, and names uploaded to our "Smart-Layer" engine.

1.3 Sensitive Personal Data (AI Biometrics): When utilizing our AI Face-Swap technology, our system processes facial geometry and textures. Note: This data is used exclusively for image compositing and "Generative Me-Commerce" rendering. We do not use this data for biometric identification, authentication, or building facial recognition profiles.

2. DATA USAGE & THE "INVINCIBLE ENGINE"

2.1 Primary Purpose: Your data is used to orchestrate the creation of your 1-of-1 products and to facilitate global logistics.

2.2 No AI Training on Private Data: Nijikart is committed to AI Ethics. We do not use your personal photos, faces, or private text to train our public generative AI models. Your data is processed within a secure "silo" specifically for your order.

2.3 Automated Verification: We utilize AI-driven orchestration to verify "Premium Protection" remake claims and to perform quality checks on image resolution before manufacturing.

3. CONSENT & BIOMETRIC PROCESSING

3.1 The "Data Fiduciary" Role: Under the DPDPA, Nijikart acts as the Data Fiduciary. By uploading a photo, you provide "Informed Consent" for its processing.

3.2 Third-Party Likeness: You represent and warrant that you have obtained explicit consent from any third party whose likeness appears in your uploaded assets. Nijikart is not liable for unauthorized uploads of third-party imagery.

3.3 Retention & Purge Policy: To support our Premium Protection remake service, assets are retained for 30 days following delivery. On day 31, high-resolution assets and biometric "compositing maps" are automatically purged from our active production servers.

4. DATA DISCLOSURE: WHO SEES YOUR DATA?

4.1 Global Manufacturing Network: We share only the final "Print-Ready" composited files with our manufacturing partners. They do not receive your biometric maps or raw account data.

4.2 Independent Sellers: For "Maker Mode" products, the Seller receives only the data necessary for manual crafting and shipping.

4.3 No Monetization of Data: Nijikart never sells, rents, or trades your personal photos, faces, or memory-data to third-party advertisers or data brokers.

5. YOUR RIGHTS (DPDPA 2023 COMPLIANCE)

You have the following rights regarding your personal data:

  • Right to Access & Summary: Request a summary of the data being processed.
  • Right to Correction & Erasure: Update inaccurate data or request deletion (subject to the 30-day fulfillment window).
  • Right to Withdraw Consent: You may withdraw consent at any time; however, this will result in the immediate cancellation of any active orders. Please note that any financial resolution or credit issued due to order cancellation resulting from a withdrawal of consent will be strictly governed by our Refund Policy.
  • Right to Grievance Redressal: If you feel your data has been mishandled, you have the right to contact our Grievance Officer.

6. SECURITY & ENCRYPTION

We utilize bank-level SSL encryption and "Zero-Trust" architecture for our processing layers. While we employ rigorous security measures, you acknowledge that uploading data to an internet-based platform involves inherent risks.
